What is Consular Processing?
Unlike adjustment of status, consular processing involves applying for a green card from a U.S. embassy or consulate, making it the path for individuals residing abroad.
Who Qualifies for Consular Processing?
You may be eligible for consular processing through one of these categories:
- Family-Based Green Cards: Immediate family members of U.S. citizens or lawful permanent residents can apply for a family-based green card.
- Employment-Based Green Cards:S. employers can sponsor an employment-based green card for skilled workers, foreign employees, or individuals with extraordinary abilities.
There are several other options including humanitarian green cards and green cards through investment.

Consular Processing Application Steps
1. Filing the Petition
Your U.S.-based petitioner will submit an official petition on your behalf. It can be:
- Form I-130 (Petition for Alien Relative): Filed by a qualifying family member
- Form I-140 (Petition for Immigrant Worker): Filed by a U.S. employer
2. Petition Approval and Case Transfer to NVC
Once the petition is filed, USCIS will review it. This process may take several months. After approval, your petition will be sent to the National Visa Center (NVC) for further processing.
3. National Visa Center (NVC) Processing
Once the petition is approved, it will be transferred to the NVC, which manages the immigrant visa process. The NVC will provide instructions on submitting necessary documents, paying visa application fees, and scheduling the visa interview.
- Submit civil documents (birth certificates, marriage certificates, police certificates, etc.).
- Pay visa fees.
- Complete Form DS-260 (Immigrant Visa and Alien Registration Application).
We recommend regularly checking the U.S. Visa Bulletin to stay informed of your priority date for your visa application.
4. Attend the Visa Interview
Once a visa becomes available, your home country’s U.S. embassy or consulate will schedule an interview. During the interview:
- You’ll answer questions about your background, the petition, or employment details.
- You’ll provide proof of financial support and undergo a medical examination from an approved doctor.
The consular officer will decide to either deny or approve your visa application.
5. Visa Approval and Entry into the U.S.
If approved, you will receive a sealed visa packet to present to a Customs and Border Protection (CBP) officer at your port of entry. Once admitted, you’ll officially become a lawful permanent resident of the United States.
