Who is Eligible for a K1 Visa?
You should meet the following requirements before applying for a K1 Visa:
- You are a U.S. citizen.
- You and your fiancé must be legally able to marry. – Proof of eligibility (divorce decrees or death certificates from previous spouses) must be included with your application.
- You have a genuine relationship. – Relationship documentation may consist of photos, communication records, and affidavits from friends or family.
- You’ve met in person. – You and your fiancé met in person at least once within two years before applying (unless cultural or religious reasons apply).

The K1 Visa Application Process
- Filing the Petition: The U.S. citizen files Form I-129F to the United States Citizenship and Immigration Services (USCIS). This form helps to establish a valid relationship between the petitioner and their fiancé, as well as proof of intention to get married within 90 days of entry into the U.S.
- Approval of Petition: Once the petition is filed, USCIS will review and decide whether to approve or deny it. USCIS will send the petition to the Department of State (DOS) National Visa Center (NVC) for further processing if approved.
- Visa Processing: After the NVC receives the approved petition, they will send it to the U.S. embassy or consulate in the fiancé’s home country for visa processing. The fiancé will then have to attend an interview and provide additional documentation as requested by the consular officer.
- Medical Exams and Police Clearance: As part of the visa process, the foreign fiancé must undergo a medical exam to meet immigration health requirements. Additionally, they must submit a police clearance certificate from their country of residence.
- Approval and Issuance of Visa: If all goes well, the consular officer will approve the K1 visa and issue it to the foreign fiancé. They will then have 6 months to enter the U.S.
- Adjustment of Status: Once they arrive, they must get married within 90 days. Then, the spouse can apply for adjustment of status to become a lawful permanent resident (LPR).
