The K1 Visa Application Process

  • Filing the Petition: The U.S. citizen files Form I-129F to the United States Citizenship and Immigration Services (USCIS). This form helps to establish a valid relationship between the petitioner and their fiancé, as well as proof of intention to get married within 90 days of entry into the U.S.
  • Approval of Petition: Once the petition is filed, USCIS will review and decide whether to approve or deny it. USCIS will send the petition to the Department of State (DOS) National Visa Center (NVC) for further processing if approved.
  • Visa Processing: After the NVC receives the approved petition, they will send it to the U.S. embassy or consulate in the fiancé’s home country for visa processing. The fiancé will then have to attend an interview and provide additional documentation as requested by the consular officer.
  • Medical Exams and Police Clearance: As part of the visa process, the foreign fiancé must undergo a medical exam to meet immigration health requirements. Additionally, they must submit a police clearance certificate from their country of residence.
